Terms of Use

Version 2026-09-26

These Terms of Use are the agreement between you and Red Nana for your use of Red Nana. Please read them. The short version: you must be an adult; you pay with credits and credits expire on the schedule in section 5; subscriptions renew automatically until you cancel; you own what you make and you are responsible for what you do with it; if you hire or work as a Pro, section 7A sets the fees, refunds and the dispute process, and Pros are independent contractors, not our staff; and disputes with us are settled by individual arbitration unless you opt out within 30 days.

BY CREATING AN ACCOUNT OR USING RED NANA YOU CONFIRM that you have read and agree to this agreement and to our Privacy Policy, that you are at least 18 years old (or older if that is the age of majority where you live), and that no law where you live bars you from using the service. If you do not agree, do not use Red Nana.

SUBSCRIPTIONS RENEW AUTOMATICALLY. If you buy a plan, it renews at the end of each billing period at the price then in force, and your payment method is charged, until you cancel. Section 4 explains how to cancel and what happens when you do.

ARBITRATION, AND A WAIVER OF CLASS ACTIONS AND JURY TRIALS. Section 18 says that almost every dispute between you and us is resolved by binding individual arbitration rather than in court, that you give up the right to a jury, and that you may not bring or join a class action. You can opt out within 30 days of first agreeing, and section 19.8 says how. Opting out costs you nothing and changes nothing else in this agreement.

1. Who we are, and what this covers

Red Nana is an AI image and video generation service at rednana.ai. "Red Nana", "we" and "us" in this agreement mean Red Nana, a trade name (d/b/a) of AJV Entertainment LLC, a Florida limited liability company at 7200 Westpointe Blvd, Orlando, Florida 32835, United States. You can reach us at hello@rednana.ai.

This agreement covers rednana.ai, every page and feature on it, and everything the service produces for you. If you are using Red Nana for a company or other organisation, you are confirming that you are allowed to accept these terms on its behalf, and "you" then means both you and that organisation.

Your licence to use Red Nana. As long as you keep to this agreement, we give you a personal, non-exclusive, non-transferable and revocable right to use the service for your own purposes, personal or business. That right is not a sale, and it ends when this agreement does.

Extra terms for particular features. Some features may come with their own additional terms, shown to you at the point you use them. Where those terms conflict with these, they win for that feature only. If we have signed a separate written agreement with you or your organisation, that agreement wins over these terms to the extent the two disagree.

Changes to the service. Red Nana changes as it improves. We may add, alter or remove features, and section 10 explains what happens when a model or feature you rely on goes away.

2. Your account

Your account is a right to use the service, not property. We may reclaim a username that misleads people or that infringes someone else's rights.

3. Fair use of the service

We may set limits on how much you can generate, how quickly, how large a file can be, and how many jobs can run at once, and we may change those limits. Some limits vary by plan. We may enforce them by queuing, slowing or refusing requests.

You must not try to get around a limit — by opening extra accounts, spreading work across accounts, or any other method. Automated or industrial-scale use that is out of proportion to normal individual use may be slowed, queued behind other work, or stopped.

4. Plans, billing and renewal

Accounts without a plan. Creating an account is free, but generating is not: there are no free credits. To make anything you buy a credit pack or choose a plan. An account without a plan gets one image per generation and resolution is capped, and its renders carry a small Red Nana mark.

Paid plans. We offer Lite, Pro and Studio, each billed monthly or annually. An annual plan is charged in full at the start of the year and costs 15% less than twelve monthly payments; the year's credits are granted up front.

Introductory offers. From time to time we offer a lower price for the first month of a plan (for example, Lite for $10 for the first month with the code WELCOME10). An introductory price applies only to your first monthly payment on your first ever subscription, and only while the offer is running. After that month the plan renews automatically at its regular monthly price, shown next to the offer before you pay, until you cancel. You can cancel at any time before the renewal date from Manage plan and you will not be charged again.

How payment works. Payments are processed by Stripe, Inc. You give your card details to Stripe, not to us — Red Nana never sees or stores your card number. Stripe's own terms and privacy policy apply to that part of the transaction. Your bank may decline a payment or add its own fee, and neither is something we control. The Stripe customer portal, linked from your account settings, is where you change your payment method, switch plan or billing period, and cancel.

Automatic renewal. Your subscription continues and renews automatically at the end of each billing period, at the price then in force, until you cancel. By subscribing you authorise us to charge your payment method now and at the start of each renewal.

Price changes. If we raise the price of your plan, we will email the address on your account at least 30 days beforehand. A new price applies only from your next renewal — the term you have already paid for never changes price. If you do not want to pay it, cancel before that renewal.

Failed payments. If a renewal payment fails, your account is past due, Stripe retries, and some features may be limited while that is happening. You have a cure window — normally 14 days from the failed payment — to fix your payment method. If payment still does not go through, the subscription ends and the account drops to the free tier. Paying late does not move your renewal date. Credits already in your account are not taken away when a subscription ends.

Cancelling. Cancel from the billing portal in your account settings, or email us from the address on the account. Cancellation takes effect at the end of the period you have already paid for; you keep access and your credits until then, and there is no charge afterwards. Cancelling does not delete your account or your work — for that, see section 13.

Upgrades and downgrades. An upgrade takes effect immediately and you are charged the difference. A downgrade takes effect at your next renewal, and may reduce the features, quality settings or capacity available to you from that date.

Trials and promotional pricing. If we offer a free trial or an introductory price, then unless we say otherwise the plan converts to the standard price at the end of that period and renews normally. Cancel before the period ends if you do not want to be charged.

Tax. Prices exclude sales, use, VAT and similar taxes unless stated. Where we must collect such a tax, it is added to the price.

5. Unlimited plans and passes

Some things on Red Nana are not metered. A paid plan may include a model you can run without spending credits, and you can buy an unlimited pass — a single payment that covers one model for a set number of days. What is included is shown on the plan and on the pass before you buy it.

6. Credits

Credits are the unit you spend to generate images and video. They come with paid plans and can also be bought as one-off packs on any plan, including the free tier. Our records of what you were granted and what you spent are the authoritative account of your balance.

Auto top-up. You can ask us to buy a credit pack for you automatically whenever your balance drops below a line you choose. You pick the line and the pack; the card is saved with Stripe, and each top-up is charged to it at the pack's current price and shown on your receipts. We never make more than three top-ups a day, and after a declined charge we stop until you change the card or turn the setting on again. You can turn it off, or remove the card, at any time on the Credits page. Credits bought this way are one-off packs and last twelve months.

Do credits expire? Yes, depending on where they came from:

Where the credits came fromHow long they last
Monthly subscriptionUntil the end of the following calendar month, so an unused month rolls over once
Annual subscriptionThe whole year's credits are granted up front and last thirteen months
One-off credit packTwelve months from the date of purchase
Promotional or goodwill credits granted by usNever expire unless we say so when we grant them
Bought before credits had an expiry dateNever expire. They were sold as non-expiring and stay that way

When you generate, credits are drawn down soonest-to-expire first, so the ones closest to their date are always used before anything else.

7. Refunds

Within seven days, if you have not used it. You may ask for a refund of a first-time purchase within seven days, provided none of the credits from that purchase have been spent. The same applies to a one-off credit pack and to the extra amount paid for a mid-term upgrade. Email hello@rednana.ai from the address on the account.

Otherwise. We do not refund credits that have been spent on a completed generation, and we do not refund the remainder of a subscription period after you cancel — you keep access and your credits for the rest of it instead. Renewals are not refundable.

If we end your account. If we close your account or discontinue the service for a reason that is not your breach of this agreement, we will refund the unused portion of any prepaid subscription and any unused credits you paid for. If we close it because you broke this agreement, fees already paid are not refunded, and unused credits are forfeited to the extent the law allows.

Where consumer law where you live gives you stronger rights than this section, those rights apply and nothing here takes them away. If you are in the EU or UK, see section 17.

Refunds for work bought through Hire a Pro follow section 7A, not this section.

7A. Hire a Pro — the marketplace

What it is. Hire a Pro lets one Red Nana user (a "client") pay another (a "Pro") for a fixed-price piece of work — an image or video edit, prompt writing, a brand kit, a consultation — described in a service listing, and lets Pros list such services. Red Nana runs the marketplace, collects the payment, holds it while the work is done and pays the Pro out. We are not a party to the work itself. The contract for the work is between the client and the Pro, on the terms of the listing and the client's brief, and this section.

Pros are independent. A Pro is an independent contractor and a separate business from us. A Pro is not our employee, agent, partner or representative; we do not set their hours, supervise their work or promise that any Pro is qualified, licensed or insured. Pros set their own prices and choose which orders to accept. A Pro is responsible for their own taxes, registrations and permits, and for any credits, plans or other resources they use to do the work. We may suspend or remove a Pro listing at any time, including for complaints, disputes, suspected fraud, or breach of this agreement.

Fees. Every listing shows a price. The client pays that price plus a service fee of 5% of the price (minimum 1 US dollar), shown separately before payment. From the price, we keep a commission of 15% and pay the remainder to the Pro. Both numbers are shown to each side before they commit: the client sees the total; the Pro sees what they receive. We may change the fees for future orders with notice under section 20; an order keeps the fees it was placed under. Payouts to Pros are made through Stripe; a Pro must complete Stripe's onboarding and agree to Stripe's Connected Account Agreement to be paid, and Stripe may hold or delay a payout under its own terms. Payouts wait seven days after the client accepts the work, so a problem raised in that time can still be put right.

Paying and holding. The client pays the full amount when placing the order. We hold it until the order is complete; nothing is paid to the Pro before then. The Pro has 48 hours to accept an order. If they decline, or do not answer in time, the order is cancelled and the client is refunded in full. Once accepted, the Pro must deliver by the listing's delivery time. If the delivery is late, the client may cancel for a full refund at any time before the work is delivered.

Delivery, acceptance and revisions. When the Pro delivers, the client has three days to accept the work, ask for a revision (if the listing includes any), or report a problem. If the client does nothing for three days, the work is accepted automatically. When the work is accepted, the delivered files are copied into the client's library and the Pro is paid. A revision request returns the order to the Pro with the client's note; a listing's revision count is the number of such requests included in the price.

Refunds and disputes. Before the work is delivered, refunds are automatic in the cases above (declined, not answered in time, late and cancelled by the client). After the work is delivered, a refund is available only through a dispute. A client may open a dispute before accepting the work, stating what is wrong. We will look at the listing, the brief, the delivery and the messages on the order, may ask either side for more, and will decide, in our reasonable judgement, one of three outcomes: the work stands and the Pro is paid; the client is refunded in full; or a split, in which the Pro is paid part of the price and the client refunded the rest. Our decision is final as between the client and the Pro for the purposes of the marketplace, and both agree to be bound by it; it does not limit any right either has against the other outside Red Nana. Once the work has been accepted (by the client or automatically), the order is complete and no refund is available through us. A chargeback or payment dispute raised with a card issuer on a completed order may result in suspension of the account that raised it. Where consumer law where you live gives you stronger rights, those rights apply.

Who owns the work. Once the client has accepted the work and paid, the client owns the delivered files, with the same rights and the same limits as any other output under section 9. The Pro keeps the right to show the delivered work in their Red Nana listing as a sample of their work, unless the client asks them in writing not to, in which case the Pro must take it down. Material the client shares in a brief stays the client's; the Pro may use it only to do that order. Both sides keep confidential what they learn about the other through an order and use it only for the order.

Conduct. Everything in section 8 applies to work done through Hire a Pro, on both sides: a client may not ask for, and a Pro may not make, anything section 8 forbids. Orders must be paid through Red Nana; asking or agreeing to pay for marketplace work outside Red Nana to avoid the fees is a breach by both sides and may end both accounts. Reviews may be left only by a client on an order they paid for, must be honest, and may be removed if they are not. Messages on an order are visible to both sides and to us for the purpose of resolving disputes and enforcing this agreement.

Our role and responsibility. We provide the marketplace, the payment handling and the dispute process. Sections 16 and 17 apply to Hire a Pro, and in addition we are not responsible for the quality, timeliness, legality or fitness of a Pro's work, for a client's brief or use of the work, or for anything either side does off the platform. Our total liability in connection with any order is limited to the fees we received on that order.

8. What you can generate, and what you can't

You are responsible for your prompts, for any reference material you supply, and for what you do with the results. You must not use Red Nana to create, request or share:

You also must not:

Faces and voices. If you upload or link an image or video containing a real person, you confirm that you have that person's permission to use their likeness this way, and that you may grant us the rights in section 8 over it. We use such material to make the output you asked for and for nothing else. We do not use it to identify or authenticate anyone.

9. Your content and our outputs

What you supply. You keep ownership of the prompts, images and other material you give us. You confirm you have the rights to everything you upload or link to, and that using it here breaks nobody's copyright, privacy or publicity rights. If you paste a link, our server fetches that page's image and uses it as a reference, so the same rule applies to linked material.

The licence we need. You give us permission to store, copy, process, adapt and display your material for the purpose of running Red Nana and giving you back the result. That permission goes no further than running the service, and it ends when you delete the material or your account, apart from copies sitting in routine backups for a short period and anything the law requires us to keep.

What we make for you. You own the images and videos generated for you, to the extent that AI-generated material can be owned where you live. You may use them commercially, including for clients, and your rights in outputs you have already downloaded survive cancelling your plan or deleting your account. We take only the licence we need to store, display and deliver them to you.

We do not train on your work. We do not use your prompts, reference images or outputs to train or improve AI models — not ours, and we do not supply them to anyone else for that purpose. The third-party providers that run the models process your prompt to produce the output, under their own terms; section 10 names them.

We do not put your work in our advertising unless you have made it public on Red Nana yourself, or you have told us we may.

No guarantee of originality. Outputs may not be unique. Someone else with a similar prompt may get a similar result, and we cannot promise an output is free of third-party rights. Clear the rights yourself before using an output commercially.

Feedback. If you send us an idea or suggestion, we may use it without owing you anything for it. Please do not send us anything you consider confidential.

10. AI-generated content and labelling

Everything Red Nana produces is generated by an AI model. It is not a photograph or a recording of real events, even when it looks like one.

Every image and video we generate carries embedded metadata marking it as AI-generated, using the IPTC DigitalSourceType field with the value trainedAlgorithmicMedia. This is best-effort: some platforms strip metadata on upload, and editing a file elsewhere can remove it. You must not remove or alter this marker yourself.

Several places, the EU under its AI Act among them, require AI-generated media to be labelled where it is published. That duty sits with whoever publishes it. If you post an output anywhere, you are responsible for the disclosure the law and the platform require there.

11. Third-party models, providers and availability

Generation runs on models from third-party providers: Google (Gemini and Nano Banana image models and Veo video), Kling AI (video) and fal.ai (Seedance video and Seedream images). Your prompt and any reference image are sent to the relevant provider to produce the output. Their content rules apply on top of ours, and where theirs are stricter, theirs govern that model. Their filters may refuse a request; when that happens your credits come back.

The service also depends on third-party computing capacity. Speed, queue times, quality and availability can all be affected by providers we do not control, and any time estimate we show is indicative.

Models change. Models are added, renamed, replaced and withdrawn, sometimes at short notice from the provider. Substituting one model for another is not a failure to provide the service so long as Red Nana still does substantially what it did before. If we materially reduce what a paid plan does, or withdraw a paid feature altogether, we will give you notice where we reasonably can, and you may cancel and get back the unused, prepaid part of your term.

Links to other websites are for convenience. We do not control them, we are not responsible for them, and their terms and privacy policies apply once you leave us.

12. Monitoring, moderation and reporting

We may — but are not obliged to — review prompts, outputs and account activity to enforce this agreement, keep the service safe and meet our legal obligations. We may remove or refuse to produce anything we reasonably judge to break these terms or the law, restrict or suspend an account, and, where we must, tell the authorities.

We may share information about you or your content where we reasonably believe it is necessary to comply with the law or legal process, to enforce this agreement, to answer a claim that your content infringes someone's rights, or to protect anyone's safety.

Reporting content. To report something on Red Nana that breaks these rules, email hello@rednana.ai and tell us what it is and where you saw it.

Non-consensual intimate imagery. If an intimate image of you, or of someone you are authorised to act for, has been shared through Red Nana without consent, email hello@rednana.ai with enough detail to find it and a statement that it was shared without consent. We will remove valid reports, and any copies we know of, within 48 hours.

If we ask you to take something down. If we tell you in good faith that something you made breaks these terms or someone else's rights, you will stop using and sharing it, delete it from what you control, and not regenerate it.

13. Copyright and other intellectual property complaints

We end the accounts of people who repeatedly infringe. If you believe material on Red Nana infringes your copyright, trademark or other right, send our agent a notice containing: your physical or electronic signature; what work you say has been infringed; where the infringing material is; your address, phone number and email; a statement that you believe in good faith the use is not authorised by the owner, its agent or the law; and a statement, made under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for them.

Copyright agent: Red Nana, Attn: Copyright Agent, 7200 Westpointe Blvd, Orlando, Florida 32835, United States. Email: hello@rednana.ai.

If your material was removed by mistake, you may send a counter-notice to the same address containing: your signature; what was removed and where it was; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address, phone number and email; and your consent to the jurisdiction of the federal court for the district covering Orange County, Florida, and to accept service from the person who complained. Under 17 U.S.C. § 512(f), knowingly misrepresenting that material was removed by mistake can make you liable.

Sending us a licence or a release does not oblige us, or the providers whose models we run, to produce or keep any particular content.

14. Suspension, termination and what happens to your data

You can leave at any time. Delete your account from Settings, or email us. Deletion is immediate and permanent: your account, projects, generated files, prompts and credit balance are removed, and there is no restore window. Please download anything you want to keep first. Records we must retain for tax and accounting are kept in anonymised form, with your identity stripped out. Unspent credits are lost on deletion and are not refunded unless the law requires it.

Prompt text does not live forever. The prompt and error text stored against a finished generation are erased after 90 days. Your generated images and videos are not touched by this — they stay in your library until you delete them or your account.

When we may act. We may remove content, limit features, or suspend or close an account that breaks this agreement. For anything other than a serious breach we will, where we reasonably can, tell you what happened and give you a chance to put it right first. For serious breaches — in particular sexual content involving minors, or non-consensual intimate imagery — suspension is immediate and we may report the matter.

If we close your account for breaking this agreement, you may not open another one.

The parts of this agreement that by their nature should outlast it do: ownership, the licences you granted us, the disclaimers, the limits on liability, indemnity, and section 18.

15. Your promise to cover certain claims

You agree to cover Red Nana and its officers, employees and agents against any loss, cost or liability (including reasonable legal fees) arising from your breach of this agreement, your misuse of the service, material you supplied that you did not have the rights to, your use of an output, or your breach of anyone else's rights or of any law. We may take over the defence of any such claim at our own cost, and you will help us if we do. This does not apply to our own fraud or unfair practice.

16. Disclaimers

Red Nana is provided as it is and as available, with all faults. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

We do not promise that the service will be uninterrupted, timely, secure or error-free, that any particular model will stay available, or that an output will be accurate, original, lawful, suitable for your purpose or clear of third-party rights. AI models produce results that are sometimes wrong, biased or unexpected. Outputs are not professional advice of any kind. Use your own judgement, and check before you rely on anything.

Features we describe as beta or experimental carry no warranty at all and may change or disappear without notice.

17. Limitation of liability

To the extent the law allows, we are not liable for lost profits, lost revenue, lost data, business interruption, or any indirect, incidental, special or consequential loss, however it arises and whatever the legal theory, even if we were told such loss was possible.

To the extent the law allows, our total liability for everything arising out of this agreement or your use of Red Nana will not exceed the greater of the amount you paid us in the twelve months before the claim, or 100 US dollars.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by our negligence, for fraud, or under consumer law that cannot be excluded. Some places do not allow these exclusions, in which case some of the above may not apply to you and you may have additional rights. These limits are a basic part of the deal between us.

18. If you are outside the United States

Red Nana can be reached from most countries, but we make no claim that it is appropriate or available everywhere. If you use it from outside the United States you do so on your own initiative and are responsible for complying with your local law.

Withdrawal, for consumers in the EU and UK. You may withdraw from a purchase within 14 days of making it, without giving a reason, by telling us at hello@rednana.ai. Credits are digital content supplied immediately: by buying and using them you ask us to start supplying straight away and accept that you lose the right to withdraw for the part you have used. Anything unused is refunded within 14 days of your telling us, by the same means you paid. Where this paragraph gives you more than section 6, this paragraph wins.

Export control and sanctions. You confirm that you are not located in a country subject to a United States embargo and that you are not on any United States list of restricted parties, and you agree to comply with export and sanctions law when using Red Nana.

19. Disputes, arbitration and class action waiver

Please read this section carefully. It changes how disputes between us are resolved.

18.1 Talk to us first. Most problems are cheaper and faster to fix informally, and we would rather sort things out with you than argue about them. Before either of us starts arbitration, the one raising the problem must send the other a written description of it — you to Red Nana, 7200 Westpointe Blvd, Orlando, Florida 32835, United States, or hello@rednana.ai; us to the email on your account — including enough detail to understand the claim and what is being asked for. We will both then try to resolve it, by phone or video call if that helps, within 45 days. Time limits pause while this is happening.

18.2 Arbitration. If that does not resolve it within 60 days, any dispute arising out of or relating to Red Nana or this agreement — including disputes that arose before you accepted these terms, and ones that arise after it ends — will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. Arbitration will normally take place in the county where you live, or by phone, video or documents only. The arbitrator's decision can be entered as a judgment in any court with jurisdiction.

18.3 Two exceptions. Either of us may bring a qualifying claim in small claims court, and either of us may ask a court for an injunction to stop misuse of intellectual property. Nothing here stops you from reporting a matter to a government agency.

18.4 No jury. We are both giving up the right to sue in court and to have a judge or jury decide, except as section 18.3 allows.

18.5 Individual claims only. Claims may be brought only on an individual basis. Neither of us may bring a class, collective or representative action, and an arbitrator may not combine claims or preside over any form of group proceeding. If a court decides this paragraph cannot be enforced for a particular claim, that claim alone goes to court in Orange County, Florida, and everything else stays in arbitration.

18.6 Costs. We each pay our own legal costs unless the arbitrator decides a claim was frivolous or brought for an improper purpose, or the law provides otherwise. Where the AAA rules require us to pay filing or administration fees for a consumer arbitration, we will.

18.7 Time limit. A dispute must be started within one year of when it arose, or within the period the law requires if that is longer, or it is too late.

18.8 How to opt out. You can opt out of this section entirely. Send us written notice within 30 days of first accepting these terms, to Red Nana, Attn: Legal, 7200 Westpointe Blvd, Orlando, Florida 32835, United States, or by email to hello@rednana.ai, giving your name, the email address on your account, and a clear statement that you are opting out of arbitration. Opting out costs nothing, changes nothing else in this agreement, and will not affect your account.

18.9 If we change this section. We will tell you before a material change to this section takes effect. You may reject the change in writing within 30 days, in which case the version you agreed to before stays in force between us.

18.10 If part of it fails. If any part of this section other than 18.5 is held unenforceable, that part is severed and the rest still applies.

If you are a consumer outside the United States, the mandatory consumer law of the country you live in still protects you, including any right you have to bring a claim in your local courts, and nothing in this section removes it.

20. Changes to these terms

We may update this agreement. The version you accepted is recorded against your account, so which terms you agreed to and when stays answerable. If we make a material change we will tell you before it takes effect — by email or in the service — and continuing to use Red Nana after that date means you accept the new version. If you do not accept it, stop using the service and, if you wish, delete your account. We may ask you to accept the new version before you continue, and may pause access until you do; that pause does not extend your subscription term. Changes to section 18 follow paragraph 18.9 instead.
